Rethinking ‘Red Lines’

The Wrong ‘Red Line’ (expanded and revised Al-Jazeera opinion piece)

 

            There are widespread reports circulating in the media that President Obama had not fully appreciated the political consequences of responding to a question at an August press conference that asked about the consequences of a possible future use of chemical weapons by the Assad regime. Obama replied that such a use, should it occur, would be to cross ‘a red line.’ Such an assertion was widely understood to be a threat by Obama either to launch air strikes or to provide rebel forces with major direct military assistance, including weaponry. There have been sketchy reports that Syria did make some use chemical weapons, as well as allegations that the reported use was ‘a false flag’ operation, designed to call Obama’s bluff. As the New York Times notes in a frontpage story on May 7th, Obama “finds himself in a geopolitical box, his credibility at stake with frustratingly few good options.” Such a policy dilemma raised tactical issues for the U.S. Government about how to intervene in the Syrian civil war without risking a costly and uncertain involvement in yet another Middle Eastern war. Not responding also raises delicate questions of presidential leadership in a highly polarized domestic political atmosphere, already shamelessly exploited by belligerent Republican lawmakers backed by a feverish media that always seem to be pushing Obama to pursue a more muscular foreign policy in support of alleged America’s global interests, as if hard power geopolitics still is the key to global security.

 

            What is missing from the debate on Syria, and generally from the challenge to American foreign policy, is a more fundamental red line that the United States at another time and place took the lead in formulating—namely, the unconditional prohibition of the use of international force by states other than in cases of self-defense against a prior armed attack. This prohibition was the core idea embodied in the United Nations Charter, embedded in contemporary international law, and it was also a natural sequel to the prosecution and punishment of surviving German and Japanese leaders after World War II for their commission of Crimes against Peace, which was the international crime associated with engaging in aggressive warfare.  The only lawful exception to this prohibition was a use of force consistent with the terms of a prior authorization given by the UN Security Council. The key hope for world peace was this consensus among the winners in World War II that in the future aggressive war and any acquisition of territory by force, even acquired in the exercise of self-defense, must be outlawed without exceptions. Such authorizations by the Security Council were obtained by the West in the Gulf War of 1991 and again in the NATO Libya War of 2011, but in each instance the actual undertaking became controversial as a result of the scope and intensity of the military operations far exceeding the UN mandate. As a consequence, there was a loss of trust on the part of China and Russia in endorsing limited uses of force under UN auspices, which became evident in the course of the gridlocked debate about what to do in response to the regionally dangerous violence in Syria that combined internal strife with external proxy involvements threatening the expansion of the war zone in a variety of menacing ways.

 

            Actually the Charter red line has been surprisingly well respected over the period since 1945, at least in clear instances of border-crossing sustained violence. The UN authorized the defense of South Korea in response to an armed attack by North Korea in 1950. The UN, with surprising U.S. support, even exerted effective pressure in 1956 on the United Kingdom, France, and Israel to withdraw from territory seized after their attack on Egypt, which was the sole prominent example of law prevailing over geopolitics. In 1991 the UN successfully authorized force that followed sanctions, and succeeded in restoring the sovereignty of Kuwait after Iraq’s aggressive occupation and annexation of the country in the previous year. The UN red line held up reasonably well until the end of the last century, although all along its interpretation was subject to geopolitical manipulations by reference to a variety of loopholes and evasions associated with claims of humanitarian intervention, as well as a variety of strategically motivated covert interventions (e.g. Iran 1953, Guatemala 1954). This pattern of evasion was a prominent feature of the Cold War as both sides intervened in foreign states or in their respective spheres of influence (e.g. South Vietnam, Eastern Europe, Afghanistan) to uphold by force of arms an ideological alignment with one or the other superpower. Such uses of international force by rival superpowers without engaging the UN framework definitely eroded the authority of the anti-aggression red line and its stature in international law, but it did not lead political actors to call for its abandonment in view of the behavior of leading states. It is true that some anti-legalist international law specialists who subscribed to a realist worldview felt that patterns of state practice overrode the claims of international law and the UN Charter, and that, in effect, the red line had been erased, at least for the top tier of sovereign states. Although not made explicit, the American position was increasingly exhibiting the psychological characteristics of geopolitical bipolarity: no red line for American foreign policy, while maintaining a bright red line for others, especially for adversary states.

 

            What weakened this red line even more decisively was undoubtedly the American led ‘coalition of the willing’ attack on Iraq in 2003 after an American plea for UN permission to use force had been rebuffed by the Security Council despite a concerted effort to convince its members that Iraq’s supposed possession of weapons of mass destruction was such a great menace to world peace as to justify what amounted to a ‘preventive war’. This undisguised defiance of this most fundamental red line of international law by the United States also defied world public opinion that had expressed itself in the most massive anti-war demonstrations in all of history held in some 80 countries on February 15, 2003, a little more than a month before the ‘shock and awe’ start of the Iraq War.  Richard Perle, often touted as the most astute of the neocon intellectuals who fashioned American strategic policy during the Bush years, was exultant about this seemingly definitive breach of the red line, celebrating American aggression against Iraq in a Guardian article aptly headlined, “Thank God for the Death of the UN.” [March 20, 2003] Although the authority of the UN was definitely flouted by the invasion and occupation of Iraq, the UN is far from dead as an Organization in its manifold efforts to address the concerns of the world, and even its red line, although covered with dust, has not yet been erased. Maybe we should really thank God that the collective global consciousness is so forgetful!

 

            What is baffling about the Obama approach is that it purports to be very mindful of the importance of exhibiting respect for international law. Just last September in a speech to the General Assembly Obama said, “We know from painful experience that the path to security prosperity does not lie outside the boundaries of international law..” In his Second Inaugural Obama repeated the sentiment: “We will defend our people and uphold values through strength of arms and rule of law.” And in arguing on behalf of taking collective action against states that violate international law told the Nobel Peace Prize audience in Stockholm, “[t]hose that claim respect for international law cannot avert their eyes when those laws are flouted.”

 

            And yet, when reflecting on intervening in Syria or resort to a military option in relation to Iran’s nuclear program, Obama is silent about the relevance of international law, although neither instance of contemplated uses of force can be remotely claimed to be justified as either individual or collective self-defense. And for obvious reasons, there is also no mention of circumventing the red line by failing to seek authorization for a contemplated used of force from the Security Council. Presumably since approval would not be forthcoming due to the anticipated opposition of Russia and China it was not even worth considering as a public tactic. It is true that the Clinton presidency in participating via NATO in the Kosovo War proceeded also to embark on a non-defensive war without seeking prior authorization for somewhat similar reasons as any resolution on Kosovo proposing use of force was sure to be vetoed by Russia and China. The Kosovo precedent generated worries about non-defensive military undertakings lacking a legal foundation. These were offset in the belief that a humanitarian catastrophe had been averted. The Kosovo undertaking was convincingly justified at the time on credible moral grounds of imminent genocide, on political grounds as enjoying support from almost all of Kosovo’s European neighbors, and on practical grounds as a military intervention that was feasible. In effect, the legitimacy of the intervention was allowed to offset its illegality. As it turned out the military undertaking and political follow up was more difficult than anticipated, but still achieved at a reasonable cost, within a relatively short period, and productive of zero casualties among the intervening forces.

            The question raised is whether from an overall perspective, the red line of international law at stake in Syria is more like Iraq or Kosovo/Libya. It is unlike Iraq in the sense that there is an ongoing unresolved civil war in Syria that is actively destabilizing the region and already spilling over national borders to cause unrest in neighboring countries.  Syria is also the scene of severe Crimes Against Humanity that are being mainly committed by the regime. Finally, at present, there is no end of the violence is in sight give the relative strength of the two sides. It is, however, unlike Kosovo/Libya as there are proxy states acting as participants on both sides, the Damascus regime despite its behavior maintains considerable internal support while the opposition is widely viewed with deep suspicion and fear as to its democratic credentials, its lack of inclusiveness, and its uncertain respect for non-Sunni minorities. In a sense it is essential that each conflict be assessed within its own distinctive context, which should raise for discussion whether the red lines of international law and UN authority should be crossed in this instance on behalf of the blue lines of legitimacy (saving a vulnerable people from a humanitarian catastrophe) and white lines of feasibility (likelihood of success with minimum loss of life and high probability of positive net effects).

 

            Finally, it has been argued that the changing nature of conflict has made the red line embedded in the UN Charter obsolete or at least in need of a drastically modified interpretation.  The rationale for rethinking the Charter approach to the use of force is associated with the global security situation that has resulted from terrorist attacks since 9/11 leading to the global war on terror being waged on a battlefield without national limits and increasingly doing the killing via reliance on robotic warfare on the one side and very primitive forms of disruptive violence by political extremists on the other side. Traditional ideas of deterrence, containment, and territorial defense seem almost irrelevant in relation to global security regimes when the perceived assailants are individuals who cannot be deterred, and are operating in non-territorial networks and exhibiting a readiness to die to complete their mission. As matters are proceeding the policy about force is being formulated without bothering with the red lines of international law and the UN, regressively producing once again a world of unregulated sovereign states and extremist non-states essentially deciding on their own when war is permissible. The recent Israeli air strikes on Syrian targets is illustrative: unprovoked and non-defensive, yet eliciting scant criticism in the media or even commentary about the dangers of unilateralism with respect to uses of international force. Such normative chaos in a world where already nine countries possess nuclear weapons seems like a prescription for eventual species suicide, an impression reinforced by the failure to take precautionary steps with respect to the menace of global warming. Never has the world more needed red lines that are drawn by major states, and upheld by them out of the realization that the national interest has also merged with the global interest. Arguably the red lines of the Charter need to be modified in light of the rise of non-state actors and the advent of non-territorial warfare, but such an undertaking is no where on the agenda of major states, and so the world drifts back to the pre-World War I era of unrestricted warfare, at least on the level of geopolitics.

 

            What is strange in all this is that Obama talks the talk, but seems unwilling to walk the walk. Such a disjunction invites cynicism about law and morality, and induces despair on the part of those of us who believe the world we inhabit badly needs red lines, but the right red lines. Redrawing the red lines that fit the realities of our world and keep alive hopes for peace and justice, should be the great diplomatic challenge of our time, the visionary projects of leading diplomats whose imaginative gaze extends beyond addressing immediate threats. The old red lines have been put aside in contemplating what to do in relation to Syria, but without trying to establish new red lines that can serve humanity well in what has been so far a  disorienting journey in the 21st century.

What was Wrong with Obama’s Speech in Jerusalem

            It was master-crafted as an ingratiating speech by the world’s most important leader and the government that has most consistently championed Israel’s cause over the decades. Enthusiastically received by the audience of Israeli youth, and especially by liberal Jews around the world. Despite the venue, President Obama’s words in Jerusalem on March 21st seemed primarily intended to clear the air somewhat in Washington. Obama may now have a slightly better chance to succeed in his second legacy-building presidential term despite a deeply polarized U.S. Congress, and a struggling American economy if assessed from the perspective of workers’ distress rather than on the basis of robust corporate profits. 

 

            As for the speech itself, it did possess several redeeming features. It did acknowledge that alongside Israeli security concerns “Palestinian people’s right of self-determination, their right to justice must also be recognized.” This affirmation was followed by the strongest assertion of all: “..put yourself in their shoes. Look at the world through their eyes.” To consider the realities of the conflict through Palestinian eyes is to confront the ugly realities of prolonged occupation, annexationist settlement projects, an unlawful separation wall, generations confined to the misery of refugee camps and exile, second-class citizenship in Israel, ethnic cleansing in Jerusalem, and a myriad of regulations that make the daily life of Palestinians a narrative of humiliation and frustration. Of course, Obama did not dare to do this. None of these realities were specified, being left to the imagination of his audience of Israeli youth, but at least the general injunction to see the conflict through the eyes of the other pointed the way toward empathy and reconciliation.

 

            Obama also encouraged in a helpful way Israeli citizen activism on behalf of a just peace based on two states for two peoples. A bit strangely he urged that “for the moment, put aside the plans and process” by which this goal might be achieved, and “instead..build trust between people.” Is this not an odd bit of advice? It seems a stretch to stress trust when the structures and practice of occupation are for the Palestinians unremittingly cruel, exploitative, and whittle away day after day at the attainability of a viable Palestinian state. But this farfetched entreaty was coupled with a more plausible plea: “I can promise you this: Political leaders will never take risks if the people do not push them to take some risks. You must create the change that you want to see. Ordinary people can accomplish extraordinary things.” There is some genuine hope to be found in these inspirational words, but to what end given the present situation.

 

            In my opinion the speech was deeply flawed in three fundamental respects:

                        –by speaking only to Israeli youth, and not arranging a parallel talk in Ramallah to Palestinian youth, the role of the United States as ‘dishonest broker’ was brazenly confirmed; it also signaled that the White House was more interested in appealing to the folks in Washington than to those Palestinians trapped in the West Bank and Gaza, an interpretation reinforced by laying a wreath at the grave of Theodor Herzl but refusing to do so at the tomb of Yasir Arafat. This disparity of concern was further exhibited when Obama spoke of the children of Sderot in southern Israel, “the same age as my own daughters, who went to bed at night fearful that a rocket would land in their bedroom simply because of who they are and where they live.” To make such an observation without even mentioning the trauma-laden life of children on the other side of the border in Gaza who have been living for years under conditions of blockade, violent incursions, and total vulnerability year after year is to subscribe fully to the one-sided Israeli narrative as to the insecurity being experienced by the two peoples.

 

                        –by speaking about the possibility of peace based on the two state consensus, the old ideas, without mentioning developments that have made more and more people skeptical about Israeli intentions is to lend credence to what seems more and more to be a delusionary approach to resolving the conflict. Coupling this with Obama’s perverse injunction to the leaders of the Middle East that seems willfully oblivious to the present set of circumstances makes the whole appeal seem out of touch: “Now’s the time for the Arab world to take steps towards normalizing relations with Israel.” How can now be the time, when just days earlier Benjamin Netanyahu announced the formation of the most right-wing, pro-settler government in the history of Israel, selecting a cabinet that is deeply dedicated to settlement expansion and resistant to the very idea of a genuine Palestinian state? It should never be forgotten that when the Palestinian Liberation Organization announced back in 1988 that it was prepared to make a sustained peace with Israel on the basis of the 1967 borders. By doing this, the Palestinians were making an extraordinary territorial concession that has never been reciprocated, and operationally repudiated by continuous settlement building. The move meant accepting a state limited to 22% of historic Palestine, or less than half of what the UN had proposed in its 1947 partition plan contained in GA Resolution 181, which at the time was seen as grossly unfair to the Palestinians and a plan put forward without taking account of the wishes of the resident population. To expect the Palestinians to be willing now to accept significantly less land than enclosed by these 1967 borders to reach a resolution of the conflict seems highly unreasonable, and probably not sustainable if it should be imprudently accepted by the Palestinian Authority.

 

                        –by endorsing the formula two states for two peoples was consigning the Palestinian minority in Israel to permanent second-class citizenship without even being worthy of mention as a human rights challenge facing the democratic Israel that Obama was celebrating. As David Bromwich has pointed out [“Tribalism in the Jerusalem speech,”] http://mondoweiss.net/2013/03/tribalism-jerusalem-speech.html Obama was also endorsing a tribalist view of statehood that seem inconsistent with a globalizing world, and with secularist assumptions that a legitimate state should never be exclusivist in either its religious or ethnic character. Obama went out of his to affirm the core Zionist idea of a statist homeland where all Jews can most fully embrace their Jewishness: “Israel is rooted not just in history and tradition, but also in a simple and profound idea: the idea that people deserve to be free in a land of their own.” And with embedded irony no mention was made of the absence of any Palestinian right of return even for those who were coerced into fleeing from homes and villages that had been family residences for countless generations.

            Such a regressive approach to identity and statehood was also by implication attributed to the Palestinians, also affirmed as a a lesser entitlement. But this is highly misleading, a false symmetry. The Palestinians have no guiding ethno-religious ideology that is comparable to Zionism. Their quest has been to recover rights under international law in the lands of their habitual residence, above all, the exercise of their inalienable right of self-determination in such a manner as to roll back the wider claims of settler colonialism that have been so grandiosely integral to the Greater Israel vision and practice of the Netanyahu government. And what of the 20% of the current population of Israel that lives under a legal regime that discriminates against them and almost by definition is a permanent consignment to second-class citizenship. Indeed, Obama’s speech was also an affront to many Israeli post-Zionists and secularists who do not affirm the idea of living under in a hyper-nationalist state with pretensions of religious endowments.

 

            In my view, there are two conclusions to be drawn. (1) Until the rhetoric of seeing the realities of the situation through Palestinian eyes is matched by a consideration of the specifics, there is created a misleading impression that both sides hold equally the keys to peace, and both being at fault to the same extent for being unwilling to use them.  (2) It is a cruel distraction to urge a resumption of negotiations when Israel clearly lacks the political will to establish a viable and independent sovereign Palestinian state within 1967 borders and in circumstances in which the West Bank has been altered by continuous settlement expansion, settler only roads, the separation wall, and all the signs are suggesting that there is more of the same to come. Making matters even worse, Israel is taking many steps to ensure that Jerusalem never becomes the capital of whatever Palestinian entity eventually emerges, which is a severe affront not only to Palestinians and Arabs, but to the 1.4 billion Muslims the world over.

 

            In retrospect, worse than speech was the visit itself. Obama should never have undertaken such the visit without an accompanying willingness to treat the Palestinian reality with at least equal dignity to that of the Israeli reality and without some indication of how to imagine a just peace based on two states for two peoples given the outrageous continuing Israeli encroachments on occupied Palestinian territory that give every indication of permanence, not to mention the non-representation and collective punishment of the Gazan population of 1.5 million. Obama made no mention of the wave of recent Palestinian hunger strikes or the degree to which Palestinians have shifted their tactics of resistance away from a reliance on armed struggle.  It is perverse to heap praise on the oppressive occupier, ignore nonviolent tactics of Palestinian resistance and the surge of global solidarity with the Palestinian struggle, and then hypocritically call on both peoples to move forward toward peace by building relations of trust with one another. On what planet has Mr. Obama been living? 

 

            

Responding to the Unspeakable Killings at Newtown, Connecticut

Once again, perhaps in the most anguishing manner ever, the deadly shooting of 20 children (and 8 adults) between the ages of 5 and 10 at the Newton, Connecticut Sandy Hook Elementary School, has left America in a stunned posture of tragic bemusement. Why should such incidents be happening here, especially in such a peaceful and affluent town? The shock is accompanied by spontaneous outpourings of grief, bewilderment, empathy, communal espirit, and a sense of national tragedy. Such an unavoidably dark mood is officially confirmed by the well-crafted emotional message of the president, Barack Obama.

 

The template of response has become a national liturgy in light of the dismal pattern of public response: media sensationalism of a totalizing kind, at once enveloping, sentimental, and tasteless (endless interviewing of surviving children and teachers, and even family members of victims), but dutifully avoiding deeper questions relating to guns, violence, and cultural stimulants and conditioning. What are called ‘difficult issues’ in the media reduce to what some refer to as ‘reasonable gun control’ (that is, a ban on assault weapons, large magazine clips, and somewhat stiffer gun registration rules) and to improved procedures for identifying those suffering the kind of mental disorders that could erupt in violent sociopathic behavior. These are sensible steps to take, but so far below the level of credible diagnosis as to promote collective denial rather than constituting a responsible effort to restore a semblance of security to our most cherished institutions (schools, churches, family dwellings). It is ironically relevant that almost simultaneous with the massacre at Newtown there occurred an attack on children in an elementary school in the Chinese city of Xinyang in the province of Henan, approximately 300 miles south of Beijing. The attacker slashed 22 children with a knife, and significantly there were no fatalities, suggesting the important differences in outcome that reflect the weapons deployed by an assailant. Although this is an anecdotal bit of evidence, it is suggestive that strict gun control is the least that should be done in light of recent experience, with seven instances of mass violence reported in the United States during 2012. It should be noted that Connecticut was one of the few states in the country that had enacted ‘reasonable’ gun control laws, but clearly without a sufficient impact.

 

If what is being proposed by politicians and pundits is so far below what seems prudent there is fostered a societal illusion of problem-solving while sidestepping the deeper causes, and the truly ‘difficult issues.’ It would be a mistake to attribute the overall concerns entirely to the violent texture of the American public imagination, but surely inquiry must address this atrocity-inducing cultural environment. America leads the world in per capita gun possession, violent crime, and prison population, and is among the few developed countries that continues to impose capital punishment. Beyond this, America vindicates torture and glamorizes violence in films, video games, and popular culture. Political leaders support ‘enhanced interrogation’ of terror suspects, and claim an authority to order the execution of alleged terrorist advocates in foreign countries by drone strikes oblivious to the sovereign rights of foreign states, a practice that if attempted against American targets would produce a massive retaliatory response preceded by an outburst of self-righteous outrage. At work, here, is American exceptionalism when it comes to lethal violence, with a claimed right to do unto others what others are forbidden to do unto us, a defiance of that most fundamental norm of civilized peoples an inversion of ‘the golden rule’ and basic biblical commandments.

 

There are other features of American political culture that are disturbing, including the uncritical celebration of American soldiers as ‘the finest young Americans,’ ‘true heroes,’ and the like. Or of America as the greatest country that ever existed, such a claim especially in light of recent history, is a rather pure form of hubris long understood as the fallibility that comes with excessive individual or collective inability to recognize and correct one’s own faults. It is certainly true that the government is asking American servicemen to risk their lives and mental health in ambiguous circumstances that produce aberrant behavior. To undertake counterinsurgency missions in distant countries at a lesser stage of development and much different cultural standards invites deep confusion, incites national resistance and hatred in the combat zones, and prompts responses driven by fear and rage. Recall such incidents in Afghanistan as American servicemen urinating on dead Afghan corpses, burning the Koran, and random shootings of Afghan unarmed villagers. In effect, this ethos of violence against others, constrained by the most minimal standards of accountability has to be part of the violence inducing behavior that is these days haunting civic life here in America.

 

In effect, until we as Americans look in the mirror with a critical eye we will not begin to comprehend the violence of Newtown, Portland, Aurora, Oak Creek, Tucson, Columbine, Virginia Tech. No amount of tears, however genuine, can make our children and citizens safer in the future, and even gestures of gun control seem likely, if treated as solutions rather than palliatives, are likely to be no more than a spit in a national ocean of sanctioned violence. What may be most depressing is that it seems ‘utopian,’ that is, beyond the horizon of possibility, to advocate the repeal of the Second Amendment on the right to bear arms or to renounce the kill doctrines associated with drone warfare or counterinsurgency rules of engagement.  Only moves of such magnitude would exhibit the political will to take measures commensurate with this disruptive and horrifying pattern of violence that has been an increasing source of national torment.

 

President Obama has called, as he has on prior occasions, for “meaningful action,” which is too vague to be of much encouragement. Almost certainly the main effort in American public space will be to explore the individuality of this shocking crime by way of mental disorder or tensions at home rather than to address its systemic character, which remains a taboo inquiry.

 

An Open Letter on my 82nd Birthday

            Exactly two years ago I wrote my first blog. Throughout this period it has been a bittersweet experience consisting of work, play, challenge, and occasional consternation. Many warm and generous responses have given me an appreciation of the distinctive satisfactions of cyber connectivity. Such pleasures have been somewhat offset by hostile commentary and related monitoring, not mainly for disagreements as to substance, but to find discrediting material, usually torn from context, that might induce me to resign or be dismissed from my unpaid UN position as Special Rapporteur for Occupied Palestine on behalf of the Human Rights Council. What is most distressing is not the attacks that are well known to come with this territory, but the degree to which important government officials in the United States and at the UN so easily become willing accomplices in such malicious campaigns of defamation, and do so without ‘due diligence.’

 

            Of course, someone more prudent than I, would have long ago abandoned the blogosphere, and more fully enjoyed the many serene satisfactions of southern California and the stimulating challenges of summers in Turkey. The magnetic appeal of this risky, still uncertain, medium of communication that was born in this century is both to reach others everywhere on the planet and to engage in a form of self-exploration and self-discovery that demonstrates almost daily that one is never too old to learn anew. These posts of mine have been mostly reflections of my experience around the world, interpretations of current global issues, and suggestions for a more peaceful, just, and sustainable world.

 

            I have deeply appreciated the support and most of the reactions I have received from known and unknown persons throughout the planet. At the deepest level, it makes me realize that there exists a large invisible and informal community of shared faith in the healing power of love, and less grandly, of the gratifications of dialogue. It is as a charter member of this community that makes me feel that it is valuable to remain an active participant so long as my muse permits, perhaps at a reduced rate.

 

            At the start of this experience I felt that it was best to allow all comments to appear, including the most unsavory. Yet as the months went by I realized that there is a cyber analogue to Gresham’s Law: ‘bad comments drive out good!’ I received many personal messages outside the blogosphere decrying the toxic atmosphere. This prompted me to try my best to monitor comments, excluding those that were uncivil in tone, as well as those that consisted of personal. It was not easy. It is a fine line. I was criticized for straying across it, or using my discretion in a biased manner. I listened, and have tried to be sensitive to diverse viewpoints without denying my own passions.

 

            I realize that many online media outlets allow comments to appear with only minimal filtering, but I have come to feel that this diminishes the quality and benefits of the dialogic potential of a blog, especially one devoted often to issues being debated in public space. It has taught me that while freedom of expression is a vital human right, and integral to democracy, it must be limited by context. The world is now a crowded theater. Koran burning and bible burning are the 21st century equivalent of shouting ‘fire!’ and inducing panic and causing mayhem in distant places. The problem of a blog is, of course, different. The justification for limiting expression to establish the kind of decorum that facilitates dialogue and conversation.

 

            Among the side effects of my blog has been an opportunity to publish more widely. It was encouraging to be invited to become a regular contributor to Al Jazeera’s English online opinion section. I find this brilliantly edited source of news and commentary to be far more cosmopolitan in its orientation toward events of the day than the most authoritative mainstream Western media outlets. This post-colonial de-Westernization of information and interpretative assessment is integral to building a multi-civilizational world community dedicated to the principles of humane and sustainable governance at all levels of social interaction.

 

            As time passes, the political circumstances of the peoples of the world are undergoing a variety of severe stresses, some local, others global, some presently experienced, others threatened in the near and medium future. There are extremely dangerous underlying patterns of behavior emerging: Among the most disturbing is the deterritorialization of conflict epitomized by kill lists and drone technology that ignores the sovereignty of others and defies the moral and legal limits embodied in international humanitarian law.

 

            There are also some latent opportunities that will come as surprises if acted upon. Perhaps, the reelected Barack Obama might surprise us by being willing to take steps to convince the world that he deserved the Nobel Peace Price that had been prematurely, and somewhat perversely, awarded to him in 2009. One sure way to do this would be to revive his Prague vision of a world without nuclear weapons. There will never be a better time in world politics to convene the nine governments whose states possess nuclear weapons. There is no raging geopolitical conflict, a mounting risk of a dangerous surge in the proliferation, and the many countries beset by financial crisis would welcome uplifting moves toward denuclearization. Nothing would more quickly restore America’s tarnished reputation as a benevolent force in the world than tabling a detailed proposal for phased and verified nuclear disarmament to be implemented within a decade. It is commonplace to applaud the vision but then immediately defer its realization to the distant future, which is to take back with one hand what was given with the other, raising expectations of those who are dedicated to abolishing the weaponry, and then reassuring nuclearists that they have nothing to worry about as nothing will actually happen. Now is the time for a genuine presidential initiative that is launched in Washington but negotiated under UN auspices to rid the world of the menace of nuclear weaponry, and to belatedly clear the conscience of humanity for its reliance on ‘security’ ever since1945 that rests on a genocidal doctrine of deterrence. Of course, the main responsibility for this reliance is not that of humanity, but of the governments that possess the weaponry and their supportive bureaucratic and economicmilitarized infrastructures. Even if the initiative should not succeed in achieving agreement, the effort would assure the Obama presidency of a memorable legacy.

 

            The other global challenge that presents the White House with an extraordinary opportunity for action is climate change. The world, including the United States, has ignored a multitude of wakeup calls, most recently super storm Sandy. It has also refused to take seriously the scientific consensus warning the world of the dire consequences of failing to curtail carbon emissions. Further delay is not neutral, causing a variety of effects that cumulatively disrupt the ecological balances that moderate weather, rainfall, and ocean levels to accommodate humans, plants, and animals. Inaction and denial is lavishly funded by the fossil fuel industries that have made climate skepticism so influential in the United States, and elsewhere. Nothing could do more to build the legacy of Obama’s second term than to tear down the high wall of silence that has been built to keep the dangers of global warming out of sight.

 

            It is in this spirit of concern, struggle, hope, and love that I commit myself to carry on with this journey of a still aspiring citizen pilgrim journeying ever so slowly toward that unseen yet real promised land.        

Obama’s Victory, Romney’s Defeat

            Around the world even more than in the United States there is an audible sigh of relief the day after Obama won a clear mandate for a second term as president. Deconstructed it mainly meant that many more were relieved that Romney lost, rather than excited that Obama won. Yet there were some, with whom I partly agree, whose gaze carries beyond the narrow victory in popular vote (as distinct from the decisive victory in the electoral college vote), to appreciate a positive fundamental change in American demographics. The white majority coalition that Reagan fashioned so skillfully in the 1980s, achieving incredibly regressive societal results, seems to be losing out to the rising proportion of the electorate that is African-American and Latino, reinforced by the political outlook of youth and the liberal outlook of many women when it comes to reproductive rights. Perhaps, as indicative of a changing social climate were the successful referenda on state ballots in Maine, Maryland, and Washington to legalize same sex marriage and separate initiatives calling for legalizing the medical use of marijuana. Only a decade ago putting such measures on the ballot in several battleground states was understood as a brilliant tactical move by Karl Rove to mobilize the Republican base that was passionately dedicated to defeating such liberalizing initiatives, widely regarded by conservatives as signs of societal degeneracy.

 

            What makes the Obama victory surprising is that his four years in the White House had definitely demobilized his base that had been so ardent in 2008, and seemed only lukewarm in 2012. Toward the end of the recent campaign, antagonism to Romney and fears about a Republican victory, partially remobilized this base, which the Obama people effectively used to carry on their so-called ‘ground game’ that brought out the minority vote in the key states that were expected to decide the election.

 

            In this sense, the 2012 electoral result is bound to provoke some long looks in the mirror by the Republican faithful. Unless some kind of economic collapse occurs in the years ahead, it is hard to imagine that a similar kind of campaign and candidate that was offered to the American people will be any more successful in 2016, and is quite likely to be less so. After all, Romney turned out to be a great fundraiser, especially after he chose arch-conservative Paul Ryan to stand by his side, and an energetic performer on the campaign trail and a surprisingly good debater. Of course, Romney was unexpectedly assisted by a shift of momentum in his favor after the first presidential debate, a result greatly facilitated by the uncharacteristic gross under-performance by Barack Obama.

 

            What makes the Obama victory more impressive is the degree to which his first term was so disappointing to many of us who had hoped for something more. The escalation in Afghanistan was a costly failure, and the refusal to acknowledge this outcome means that the policy community will remain unencumbered by its past experience of counter-insurgency defeat. The Pentagon will be ready to go forward with yet another military intervention in a non-Western country when so instructed by civilian enthusiasts for hard power diplomacy. Worse than this persisting disposition toward military solutions for international conflicts is the expansion of drone warfare under Obama’s watch. Drone attacks are a chilling reminder that state terrorism remains an officially endorsed feature of American foreign policy, including the claim to kill American citizens wherever they may be on the planet without even the pretense of an indictment and due process. Drones let loose a new menacing technology that kills without accountability, and has been the ability to disregard the territorial sovereignty of states as well as to ignore the innocence of those who are made to live under the threat of such weaponry.

 

            On the home front, there is little to applaud in the Obama presidency to day, and quite a bit to lament. There was no attempt to explore whether crimes had been committed during the Bush presidency despite the promise to govern with a scrupulous respect for the rule of law. The treatment of the Wikileaks disclosures, and especially the abuse of the young soldier, Bradley Manning, who is accused of leaking the documents, sends a chilling signal in relation to conscience and criminality. The U.S. Government crimes disclosed in the documents, pertaining to actions during the Iraq and Afghanistan wars were totally overlooked while the entire focus of governmental concern was placed on the breach of secrecy. When state secrets are guarded so zealously and crimes against humanity are granted impunity, it is a sure sign that the republic is not morally flourishing. It reinforces the impression that America is still reeling from the combination of trauma and belligerency brought about by the 9/11 attacks. There is no reason to suppose that Obama will take steps to vindicate retroactively in his second term the premature award in 2009 of a Nobel Peace Prize. In fact, among the more disturbing sentiments expressed in his victory speech was to twice boast about the United States having the most dominant military force ever possessed throughout the whole of human history. In Obama’s extravagant words, “We want to pass on a country that’s safe and respected and admired around the world, a nation defended by the strongest military on earth and the best troops this world has ever known.” It is seems almost unnecessary to point out that the wishes expressed in the first part of the sentence are perceived to be directly contradicted by the militarist claim in the second part.

 

 

            Perhaps, we can hope for something slightly better when it comes to the economy. Obama could have been far worse, and he not only inherited a mess from the Bush era, but was faced with a Republican controlled House of Representatives that was consistently obstructionist, and did little to conceal its priority of making the Obama leadership fail. His programs of stimulus and bailouts did probably prevent a slide into a deep national depression. It remains disturbing, however, that he relied exclusively on economists friendly to Wall Street throughout the process, avoiding any reliance even on such moderate critics as Robert Reich, Paul Krugman, and Joseph Stiglitz. Nevertheless, there were some moves by the Obama administration to put a lid on the most irresponsible practices of the financial world that had generated the mortgage/foreclosure fiasco in the real estate market and its related crises affecting the leading brokerage and banking outfits.

 

            Romney was reported to have told a private fundraising gathering that the Israel/Palestine problem was not going to be resolved in the near future, and that this was okay. Obama seems to have avoided any commentary, although it became well known that Israel was the only country in the world, including it turned out, the United States, in which Romney would have been the electoral choice of the citizenry. In the United States, Jewish support for Obama declined somewhat, but was still maintained a robust 70% level.  We can expect two kinds of tests in the months ahead as to whether Obama’s approach to the conflict will change:

            –diplomacy toward Iran’s nuclear program, especially with respect to the threat of an attack launched by Israel;

            –degree of Washington’s opposition to the effort by the Palestinian Authority to obtain an upgraded non-member observer status at the United Nations.

 

            Another inexcusable failure of the Obama presidency and the presidential campaign was the widely noticed silence on the challenge of climate change. It might as time passes be noted as the clearest signal that democratic politics, deformed by special interests dispersing bundles of cash, could succeed in keeping issues vital to the wellbeing of the citizenry completely off the agenda. Such a result was aided and abetted by the media that never called attention to the concern despite record-setting heat in the summer of 2012. Fortunately, for Obama, Hurricane Sandy managed what none of the media pundits dared, forcing the recognition that extreme

events could no longer be explained away by reference to natural weather cycles. And it was notable that finally in his victory speech Obama made a fleeting reference to doing something about halting the warming trends that so dangerously imperils human health, food security, and overall wellbeing. [“We want our children to live in an America..that isn’t threatened by the destructive power of a warming planet.”] We must watch carefully to see whether this revived concern about climate change translates into high profile national policy, including global leadership, which has been entirely absent during Obama’s time as president, despite his original recognition as a candidate in 2008 of what an important challenge climate change posed for the future welfare of the country.

 

            There are two basic interpretations of the Obama victory among those who were hostile to Romney’s candidacy:

            –the dominant view is that Obama offers the American people and the world a set of expectations that were decidedly preferable to what Romney and the Republicans were offering: more people-oriented; fairer taxation, government regulation of business, and stronger commitments to a government safety net for health, housing, poverty, and education; better appointments to the courts and to government, with greater representation for women and minorities; a more positive approach to the United Nations and foreign policy; and somewhat more forthcoming on environmental issues, including climate change.

            –the minority view that when it comes to plutocracy, militarism, and the general structures of global capitalism there is no significant difference between the two parties, and that the election is in this deeper sense, irrelevant. Those adhering to such an outlook were inclined to support the Green Party candidate, Jill Stein, who articulated a genuinely progressive agenda that refused to be swayed by liberal appeals to the differences between Republicans and Democrats. The mainstream media completely ignored the existence of the Green Party perspective, which revealingly contrasted with the great attention accorded the Tea Party from its first irreverent stirrings.

 

            I felt drawn to both of these somewhat inconsistent interpretations, and because I was living in California, which was deemed super-safe for Obama, I felt that I could vote structurally, that is, for the Green Party, rather than tactically, that is, for Obama. When it came to secondary candidates and state and local issues, I cast my votes in a pattern that was the same as that of my liberal democratic friends. Of course, the question that I find more difficult to answer is whether if I had lived in Florida or Ohio, I would have risked the structural choice. There is the memory that George W. Bush defeated Al Gore in the 2000 election because 90,000 votes were cast on behalf of a Third Party candidate, Ralph Nader. The question comes down to this: is it more important to show symbolic support for a party and candidate that diagnoses the issues in a sufficiently radical manner to offer some promise of a transformative agenda, or is it better to go with the lesser of evils?

 

             I admit that in the excitement occasioned by the Obama victory last night I was prepared to admit to myself that somehow Obama and the constituencies that supported him could be harbingers of a better future for the country. This sentiment was shared, in reverse, by the pro-business community, which registered their displeasure with the electoral outcome by a major stock market selloff that drove the Dow Jones index down by more than 312 points.

 

            There was something I found inspiring and hopeful about the ethnic and racial diversity of the Obama inner core waiting in Chicago for his victory speech as compared to the stiff and formal whiteness of the Romney crowd despondently gathered in Boston for their leader’s concession speech.  At this point, my hopeful side is ready for Obama’s new mandate to outdo my modest expectations, just as in 2008 he disappointed me beyond my apprehensions. Among Obama supporters there is the belief that in this second term he will take risks in an effort to elevate his presidency to the ranks of greatness.

 

            Regardless of whether Obama pleases more than he disappoints, sending the Republicans to the sidelines is something to cheer about! And beyond this, the Green Party effort did remind me and a few others that a progressive alternative to predatory capitalism can be put forward in a coherent and compelling manner by a candidate with talent and impeccable credentials. Perhaps, we can look forward to a period when Jill Stein does for the Obama presidency what Norman Thomas, and the Socialist Party, did for the New Deal presidency of FDR, that is, be both a thorn in the side, and an inducement to stop the bleeding of disaffected party members by adopting important parts of the Socialist agenda.

   

Comparing Presidential Elections: 2008 versus 2012

            In 2008, Barack Obama rekindled faith in the America electoral process for many, and revived the deeper promise of American democracy, bringing to the foreground of the national political experience a brilliant and compassionate African American candidate. When Obama actually won the presidency, it was one of the exciting political moments in my lifetime, and rather reassuring as a sequel to the dark years of George W. Bush’s presidency. Of course, many Americans didn’t share such positive feelings, and an important embittered minority believed that the election of a liberal-minded black man was the lowest point ever reached in national politics, challenging this segment of society that now was deeply alienated from the prevailing political current to mobilize their forces so as to win back control of the country on behalf of white Christian Americans, and also a time to indulge such absurd scenarios as an imminent Muslim takeover of the society. Such polarization, gave rise to an Islamophobic surge that revived the mood of fear and paranoia that followed upon the 9/11 attacks and was reinforced by evangelical enthusiasm for Israel. In this regard, the Obama phenomenon was a mixed blessing as it contributed to a rising tide of rightest politics in the United States that poses unprecedented dangers for the country and the world.

 

            Nevertheless, as mentioned, Obama’s campaign and election was at the time a most welcome development, although not entirely free from doubts. From the outset my hopes were tinged with concerns, although I did my best to suspend disbelief. All along I found little evidence that Obama’s leadership would liberate the governing process from its threefold bondage to Wall Street, the Pentagon, and Israel.  Such a political will to mount such a challenge was never in evidence, and never materialized. Even in lucid moments, however, I reasoned it was important to elect Obama, despite his endorsement of a woefully deficient set of foreign policy assumptions, because more would be done to give assistance to those impoverished and hit by unemployment and home foreclosures, better judges and diplomats would be appointed, and more attention would be given to climate change. After four years, I continue to believe that these differences matter sufficiently to make it irresponsible not to support Obama and the Democratic Party, especially in so-called swing states.

 

And if there was excitement in much of America during the 2008 electoral campaigned, it was mild compared with pro-Obama sentiments in the rest of the world four years ago, which reached dizzying heights after his victory. This enthusiasm was a compound of several elements: Obama’s success lifted confidence throughout the world that the United States could again play a benevolent role on the global stage and also because it validated that mythic image of America as a country where it was truly possible for anyone in the society, including members of minorities long discriminated against, to reach the pinnacles of wealth and power provided only that they were sufficiently talented and determined, and some would add, lucky. There remains little doubt that if the peoples of the world were allowed to vote in American elections, as might be appropriate in a globalized world, it would have produced a landslide of unprecedented magnitude in Obama’s favor.

 

All at once in 2008 it became evident that an American presidential election was no longer just a national  ritual that bemused outsiders watched as a kind of spectacle but a global event that affected the entire world. In fact the selection of a leader for the United States might be in some respects more important for other societies than for America, and further that the outcome of an American election could have a greater impact on a country in Asia, Africa, and Latin America than the effects of their own national elections, a significance reinforced by intense global media coverage of the American election in real time. In this respect, the 2008 election of Barack Obama made many of us aware that ‘political globalization’ was now as much a part of our experiences as ‘economic globalization.’ We were no longer living in a world where the standard map based on the borders of territorial sovereign states depicted the essential organization of political life on the planet. Our globalizing world had made the geopolitical cartography of influence much more spatially elusive, almost impossible to depict visually, but no less real.

 

Overall, the initial candidacy and election of Obama was, despite my qualms, more about hope than fear. There were concerns to be sure that the McCain/Palin Republican opposition would be dangerous for the world, but such anxieties were relatively subdued, and did not extinguish the strong positive expectations generated by Obama. And these hopes seemed somewhat justified in the first months of his presidency. In April Obama delivered a visionary speech in Prague that articulated a strong commitment to work toward a world without nuclear weapons. The newly elected president also seemed determined to carry out his campaign pledge to end the Iraq War in a responsible fashion, although this welcome move was offset by a disquieting hint that such a demilitarizing move in Iraq would be balanced by an increased commitment to prevailing in the ongoing war for the control of Afghanistan.

 

 

In June Obama made a relatively forthcoming speech in Cairo promising a new more positive relationship with the Islamic world as a whole and to the Middle East in particular. The president referred to the long ordeal of the Palestinian people and proclaimed his dedication to achieving a peaceful and just resolution of the Israel/Pa;lestine conflict, including a most reasonable call upon Israel to freeze all settlement expansion while peace negotiations were taking place. That this call on Israel to stop unlawful activity during negotiations was treated by the media as such a bold step tells us just how biased the mainstream attitude toward the conflict had become, and when Israel rejected at Obama ‘s moderate plea it experienced no adverse consequences, although the White House was put on the defensive because it had dared to push Israel to take a step that was against its wishes. This initiative, followed by its withdrawal, demonstrated to the world the extent to which the United States Government was in Israel’s corner, was revealed to all who cared to notice that the only superpower in global politics was a paper tiger when it came to the pursuit of a just outcome of the conflict.

 

            As already indicated, I half expected disappointments in 2008. I worried about Obama’s typical liberal effort to demonstrate his tough approach to national security including support for a bloated defense budget in the face of a fiscal and employment crisis, about his lame effort to distinguish between Iraq as a bad war and Afghanistan as a war necessary for American security, and hence a good war. Also, I was disturbed by the way Obama dumped Rev. Jeremiah Wright when he became a liability to his electoral campaign, seemed embarrassed by his friendship with the distinguished Palestinian political historian, Rashid Khalidi, and made Rahm Emanuel chief of staff, as his first major appointment. Obama surrounded himself with economic advisors who were the same folks that had collaborated with the banks, hedge funds, and big brokerage houses in the 1990s to facilitate the huge regressive redistribution of wealth in the spirit of ‘casino capitalism.’ Unfortunately, these telltale signs of weakness of principle and ideology were an accurate foretaste of what was in store for the country during the next four years, although it apparently never dawned on the Nobel Peace Prize Committee to withhold its coveted award until Obama demonstrated that he was a deserving recipient, which sadly he never did.

 

            What happened during the first term of the Obama presidency is definitely disappointing, although it is only fair to acknowledge that extenuating circumstances existed. Obama was dealt ‘a bad hand’ in the form of the worst economic crisis since the Great Depression of the 1930s. American society was sliding to the right as exhibited by the rise of the Tea Party, and the election of increasingly reactionary politicians as senators and congressmen, creating the most rightwing Congress in memory.  It was difficult to govern in such a setting, and Obama compounded the difficulties by moving more than half way to meet the unreasonable demands of the opposition, and continued to do so even in the face of their clear unwillingness to reciprocate in a corresponding manner. Also, the pressures mounted by Israel and its formidable AIPAC lobby led the White House to back pedal awkwardly with respect to its efforts to create an atmosphere conducive to a balanced peace process for Israel and Palestine. On other issues, as well, Obama followed the pollsters and the party insiders more than principle, and failed to do what was best for the country and the world. After promising to take climate change seriously, Obama led an international effort to avoid imposing legal constraints on carbon emissions, and throughout his reelection campaign in 2012 has done his best to avoid the looming challenge of global warming aside from blandly promoting energy independence and green technology. As a result, the near unanimous scientific consensus on the urgent need for mandatory strict limits on carbon emissions has been disastrously pushed further and further into the background of public consciousness.

 

            For me the 2012 elections have a different tone and relevance,  that is not less consequential than in 2008, although absent the uplift. I believe this time around the stakes in the presidential election have been reversed. The upcoming election is more about fear than hope. The outcome is as fateful, or possibly more so, for the American people and the world, especially those living in the Middle East, but fateful also in the sense of avoiding the worst, not hoping for the best, or at least something better. Romney’s election, even if he means only 50% of what he is saying, could lead to military confrontation with Iran, a completely free hand for Israel, an effort to undermine and control democratic forces in the main Arab countries, a trade war with China, a deepening of the world financial and employment crises, reduced respect for human rights, especially the reproductive rights of women, and a return to the overt lawlessness of the Bush presidency. Obama if reelected would likely be a more prudent leader, although continuing to throw the weight of American influence mostly on ‘the wrong side of history.’ In this sense, although prudence is to be preferred to recklessness, there are no major principled differences between the candidates when it comes to foreign policy (on domestic policy there is). Romney proposes that the U.S. stay longer in Afghanistan, move closer to an attack mode with Iran, and challenge China more vigorously on economic policy, and Obama agrees with all these positions but pursues them in a more nuanced way, with a greater seeming sensitivity to the risks and pitfalls, but nevertheless adhering to the same misguided and regressive policy options.

 

            When fear rather than hope shapes our political consciousness, the effect on the citizenry is likely to be despair. Such an effect induces collective depression and encourages extremisms. What is also scary is the degree to which those who are making us fearful are being aided and abetted by the deep pockets of extremist billionaires who seem clearly to sense their ability in this period to buy enough votes to distort the will of the citizenry, and if they should be successful will step up to the policy window to cash in their chips, which could produce some disastrous results at home and abroad. In the background, of course, is the disappointment with the political consciousness of the citizenry that seems so receptive to such a dysfunctional and menacing political agenda as is being presented to them by the Republican Party; it does inspire confidence that the democratic way can lead toward sustainability, security, and justice in the years ahead.

 

            With such an understanding why not support the Green Party candidacy of Jill Stein and Cheri Honkala? Their positions seem principled and admirable, and their alignments are with the poor and with the environment. Their platform is inspirational and congenial compared to what the Republicans and Democrats offer the American people. But their capacity to govern is untested, and their level of support is minimal.

 

            I ask myself whether a vote for the Green Party in light of these circumstances would be a wasted vote? It evades the question to observe that in some states, say California or Nebraska, the outcome is so clear that takingsides as between the candidates put forward by the Democrats and Republicans is meaningless. The real test is whether it is worth voting for the Green Party candidates as a matter of principle because they are decent enough not to stoop to the dirty games of money and the accommodation of special interests that are poisoning the political process in the United States. At this point, I am not able to resolve my doubts. Is it irresponsible, given what is at stake, not to vote for the lesser of evils? Is it a misunderstanding of modern democracies to expect clear choices based on principled positions, respect for international law and human rights, dedication to environmental protection, sustainable economic policies, and a commitment to social justice for the entire population? Should we not insist on this misunderstanding to avoid ourselves being entrapped in a demeaning morality that overlooks crimes of state? (for instance, drone terror)

 

            I must admit if living in a swing state I would vote for Obama, not having sufficient courage of my convictions to risk symbolic responsibility for a Romney victory!

 

Language, Law, and Truth

            Marjorie Cohn, a respected progressive commentator on the use and abuse of international law during the past decade, notes with justifiable horror the willingness of Republican candidates for president to endorse torture as an acceptable instrument of counterterrorism. [Cohn, “US Presidential Elections: GOP Candidates Advocate Torture,” Nov. 19, 2011] Rick Perry, one leading Republican presidential contender who is now governor of Texas, put his support for torture in typically crude language: “This is war. That’s what happens in war.” The most direct endorsement was made by Herb Cain, a businessman who repeatedly demonstrates his scant knowledge of foreign policy issues, said with sprightly ignorance of waterboarding during a recent TV debate among the Republican candidates, “I don’t see it as torture. I see it as enhanced interrogation technique.” Not to be left behind in this rather alarming Republican horserace for the presidential nomination, Michelle Bachmann, attempted to give a pragmatic twist to the discussion by claiming (contrary to the evidence that torture often turns up information that is misleading and generally less useful than permissible forms of interrogation) that waterboarding is an effective means to gain information, and that as a patriot she would not hesitate to use such a technique to protect the country against its enemies. The lead candidate in opposition to Barrack Obama at this time in the November 2012 presidential election, Mitt Romney, also let it be slyly known that he shares the view that waterboarding is not torture: “Enhanced interrogation techniques have to be used. Not torture, but enhanced interrogation, yes.”

            Here we have direct examples of the dirty language games being played at great costs to the moral standing of the nation, its people, and its government. Torture is not torture if it is not called torture! Of course, in the background standing tall are George W. Bush, Dick Cheney, Donald Rumsfeld, John Yoo, and others who during the Bush presidency invented this trick designed to make torturers and their minders sleep well at night. For these unindicted war criminals, it was enough to give an unacceptably narrow definition of the legal crime of ‘torture,’ which allowed them to retain their innocence and at the same time brag about using waterboarding to save American lives, sometimes done over 100 times to a particular detainee. This Republican revival of a pro-torture argument is particularly discouraging because it seems to rest on an extremely distressing assessment of American public opinion as favorably impressed by the brutality and lawlessness of a continuing reliance on waterboarding and other forms of ‘enhance interrogation.’ If this assessment is correct it confirms the impression widespread in the world that not only has America lost its way, but has also mortgaged its soul!

            As Professor Cohn tells us, President Obama reaffirmed that waterboarding is torture, an opinion proclaimed ever since his presidential campaign in 2008, and bolstered by an insistence that since in office he has  unconditionally repudiated torture as conventionally understood. His language is instructive, but in its own way misleading: “Waterboarding is torture. Anybody that has actually read about it and understands the practice of waterboarding would say that it is torture—and that’s not something we do, period.” This renewed repudiation of waterboarding is welcome, as is the insistence on not distorting the language so as to allow those acting on behalf of the government to abuse physically and mentally persons held in detention, and even to do so with a relatively good conscience.

            But if waterboarding is torture, and Mr. Obama is true to his wider pledge to implement the rule of law during his presidency, why does he not allow investigations of the criminality on the part of his predecessors in office who acknowledged (‘confessed’) to the crime? In effect, a serious crime was repeatedly committed by the highest elected officials, damaging badly the reputation of the United States, and yet the political will to uphold the law is evidently not a feature of the Obama presidency, which early on asserted that it wanted to look forward not backward when it came to implementing law. To put it mildly, this is a peculiar ‘enforcement’ strategy that seems indistinguishable from non-enforcement! Imagine if a similar impunity was granted to common criminals for past murders and rapes! Imagine the Republican outrage! What is worse, as the comments of Republican candidates vividly reveals, this spirit of non-implementation keeps the virus of torture alive in the American body politic.

            In the good old days of the Cold War there also occurred a distressing reliance on torture and assassination, often entrusted to the CIA section on covert operations carried out overseas, well-documented and analyzed by Alfred McCoy in his book Question of Torture: CIA Interrogations, from the Cold War to the War on Terror (2006), but this behavior was kept secret, partly because it was known to be indecent and unlawful. Such a use of secrecy does not immunize the practice of torture from legal accountability had the political will and capability existed, which it did not, but it at least manifests a concern that such behavior if revealed would generate opposition and moral disgust. In the post-9/11 world, at least here in the United States, that concern and disgust while still present among urban liberals are much attenuated, which means the barriers to secret wrongdoing are likely to be virtually non-existent. And if one of these Republican torture advocates should be elected next November then it would seem likely to initiate an open season for a new round of torture undertaken beneath the feel good banner of ‘enhanced interrogation.’ At least, we can take some tiny comfort from the fact that even torture advocates still rely on this canopy of language to disguise the nature of their behavior. 

            Of course, it is easy for me to pontificate self-righteously when not faced with the dilemmas of governance. It was undoubtedly true that any attempt to impose standards of accountability on the Bush presidency would have led to an acrimonious national debate, or worse, and produced a deepening of the polarities already hamstringing the formation of public policy in the country. Yet for those who seek justice and truth in politics, such a law-oriented course of action would have been exhibited a genuine commitment to American values, and have gone a long way to demonstrate that the discontinuities between the Bush and Obama presidencies were more than halfway gestures.If a law-based democracy is ever to approximate reality, we the citizens must insist that the political risks of truth-telling be taken, that torture in our name, whether present, past, or future is totally unacceptable and will be punished no matter who turns out to be the culprit.                        

            In his speech accepting the Nobel Peace Prize in 2009 President Obama said strikingly: “Those who claim to respect international law cannot avert their eyes when those laws are flouted..The same principle applies to those who violate international law by brutalizing their own people.” But is not this precisely what Obama has been doing by averting his eyes from the crime of torture committed by his predecessors in office? This evasion of the solemn responsibility to implement international criminal law as it pertains to torture, even to investigate allegations of criminality, is accentuated by taking other backward steps suggesting ambivalence at best. Obama refused to authorize the formation a truth and reconciliation commission with a mandate to investigate past reliance on torture, which might have produced clarity, if not closure, on the issue.  As well, the Justice Department has shockingly intervened in judicial settings to prevent civil law suits by former Guantanamo detainees seeking damages from the abuse they endured on the flimsy, and morally unacceptable, grounds that as aliens they lacked clear constitutional rights, as aliens, not to be tortured.             In the same Nobel speech Obama explained his outlook on the relevance of law to warfare: “Where force is necessary, we have a moral and strategic interest in binding ourselves to certain rules of conduct. And even as we confront a vicious adversary that abides by no rules, I believe that the United States of America must remain a standard bearer in the conduct of war. That is what makes us different from those whom we fight. That is a source of our strength. That is why I prohibited torture. That is why I ordered the prison at Guantanamo Bay closed. And that is why I have reaffirmed America’s commitment to abide by the Geneva Conventions. We lose ourselves when we compromise the very ideals that we fight to defend. And we honor those ideals by upholding them not just when it is easy, but when it is hard.” Again, performance trumps rhetoric, and from this perspective Obama seems both hypocritical and cynical, not just in relation to torture, but more generally with respect to international law. 

            For the Obama presidency, the debate about the escalated use of attack drones to target suspected terrorists wherever they might be located in the world occupies a comparable space to that of torture during the Bush presidency. And what is revealing, is the similarity of manner by which the Obama people bring law to bear on this controversial use of force that has such broad implications for the future of warfare. More than their Bush counterparts, such luminaries as Harold Koh, Legal Advisor to the Secretary of State, and John Brennan, the top counterterrorist advisor to the president, emphasize the degree to which adherence to the rule of law in the conduct of American security policy is a priority that guides behavior because it reflects American values, and also works out better in the combat zones because it builds unity at home, strengthens cooperation abroad, and conveys the differences between ‘us’ (law-abiding on principled grounds) and ‘them’ (engaging in deliberate violence against civilians).

 

            But then this major premise of adherence to law is immediately contradicted by the minor premise: doing what is militarily desirable and possible to counter alleged terrorist threats associated with al Qaeda and the 9/11 experience, and this means targeted assassinations in foreign countries far from the hot battlefield, understating of civilian casualties, ignoring the frightening wider effects of drone attacks on the overall sense of societal security in a target zone, broadly defining who constitutes a threat, and a refusal to lift the veil of secrecy from drone operations to determine whether intelligence was reliable as to target and supposed threat. It is lethal behavior by the United States carried on in foreign countries, with ‘consent’ publicly denied or absent, generally undertaken by a CIA civilian operative sitting in an air conditioned office, converting ‘war’ into a risk-free process that for the drone-minder resembles a video game, and since there is no public accountability, there is also no burden of responsibility for negligence or even malice. Does not this represent an extreme stretching of the international law with respect to the right of self-defense? It also is a blatant denial of  ‘the right to life,’ an imposition of extra-judicial capital punishment, and as such, an affront to legal standards associated with international human rights.  As well it entails an utter lack of respect for the sovereign rights of other states, and in its totality, a contorted ‘legality’ put forth by government legal experts on behalf of drone warfare in a manner unnervingly similar to what the Bush legal operatives sought to do with regard to torture.

            It may be time to acknowledge that governmental lawlessness in foreign policy has become a bipartisan reality for the United States Government, and that the face in the White House or the political party in control, while not yet irrelevant, is a matter of secondary interest, at least to those who are drone targets or torture victims. 

            It may be past time to say that such a stretching of the language of law is an insult to our intelligence and a subversion of our morality as a people and nation. When ‘law’ becomes a synonym for ‘crime’ we know that power corrupts all the way to the top of the governmental pyramid!

A Modest Proposal: Is It Time for the Community of Non-Nuclear States to Revolt?

             There are 189 countries that are parties to the Nuclear Nonproliferation Treaty (NPT) that entered into force in 1970. Only India, Pakistan, Israel, and North Korea have remained outside the treaty regime so as to be free to acquire the weapons. The nuclear weapons states have done an incredibly successful job, especially the United States, in getting a free ride, continuously modernizing their arsenals while keeping the weapons out of most unwanted hands.

 

            But the NPT was negotiated as a world order bargain. The non-nuclear countries would forego their weapons option in exchange for receiving the full benefits of nuclear energy and a pledge by the nuclear weapons states to seek nuclear disarmament in good faith. After 40 years it seems time to question both the benefits of nuclear energy (especially so after Fukushima) and even more the good faith of the members of the nuclear weapons club. Back in 1996 the World Court unanimously concluded that the nuclear weapons states needed to fulfill their treaty obligation to seek nuclear disarmament as a matter of urgency, and yet nothing resembling disarmament negotiations has taken place. It seems time to declare that the good faith obligation of Article VI of the treaty has been violated, and that this is a material breach that allows all states to disavow any obligation.

 

            Two mind games have kept the non-nuclear majority of states in line so far: first, convincing the public that the greatest danger to the world comes from the countries that do not have the weapons rather than from those that do; secondly, confusing the public into believing that arms control measures are steps toward nuclear disarmament rather than being managerial steps periodically taken by the nuclear weapons states to cut the costs and risks associated with their weapons arsenals and programs and to fool the world into thinking they are living up to their obligation to phase out these infernal weapons of mass destruction.

 

            There are other problems too. Israel has been allowed to acquire nuclear weapons by stealth without suffering any adverse consequences, while Iraq was invaded and occupied supposedly to dismantle their nuclear weapons program that turned out to be non-existent and Iran is under threat of military attack because its nuclear energy program has a built in weapons potential. Such double standards and geopolitical discrimination severely erode the legitimacy of the NPT approach.

 

            Barack Obama earned much favorable publicity, and probably was given the Nobel Peace Prize, because in 2009 he made an inspirational speech in Prague announcing his commitment to a world without nuclear weapons. Although the speech was hedged with qualifications, including the mind-numbing reassurance to nuclearists not to worry, nothing would happen in Obama’s lifetime, it still gave rise to hopes that finally there would be a genuine attempt to rid the world of this nuclear curse. But it was not to be.

As with so many issues during the Obama presidency, the early gestures of promise were quietly abandoned in arenas of performance.

 

            Has not the time come for the too patient 184+ non-nuclear weapons states to stand together with the peoples of the world to challenge the world nuclear weapons oligopoly? One way would be to declare the treaty null and void due to non-compliance by the nuclear weapons states. Such a move would be fully in accord with international treaty law.

 

            Another way, perhaps more brash, but also maybe more likely to have a political impact, would be for as many non-nuclear states as possible to take a collective stand by way of an ultamatum: if the nuclear weapons states do not engage in credible nuclear disarmament negotiations designed to eliminate the weapons within two years, the treaty will be denounced.  

 

            

The American and Global Experience of 9/10, 9/11, 9/12 +10:

            There is unacknowledged freedom associated with any event inscribed in our individual and collective experience of profoundly disabling and disturbing public occurrences. For most older Americans what is most vividly remembered among such occurrences is likely to have been Pearl Harbor, the assassination of JFK, and the 9/11 attacks, each coming as a shock to a shared societal sense of exceeding the limits of what could be expected to happen.  I doubt that other societies would have a comparable hierarchy of recollections about these three rupture of expectations that have proved so significant for an understanding of American political identity over the course of the last fifty years. To make my point clearer, most Japanese would almost certainly single out Hiroshima, and possibly the more recent disaster that followed the 3/11/11 earthquake and tsunami that led to the Fukushima meltdown, and are likely to ignore the events that Americans have found so transformative. Germans, and many Europeans, are likely to be inclined to remember the fall of the Berlin Wall, and possibly the exposure of the Holocaust, while most citizens of former colonies are undoubtedly most moved by the day on which their national independence was finally achieved.

 

         Because American responses to such transformative events are likely to be global in their effect, there is a greater tendency to acknowledge some American preoccupations but not their interpretation. This diversity amid universality is probably truer for 9/11 than any other recent transformative event, not only because of the drama of the attacks and global visualization in real time, but as a result of the violence unleashed in response, what I identify here as the perspective of 9/12. Shifting ever so slightly the angle of perception greatly alters our sense of the significance of the event. Just as 9/12 places emphasis on the American response, the launching of ‘the global war on terror,’ the day before, 9/10 calls our attention to the mood of imperial complacency and global vulnerability to American power that preceded the attacks. This mood was completely oblivious to the legitimate grievances that pervaded the Arab populace associated with the appropriation of the region’s resources, the American support lent to cruel and oppressive tyrants, the lethal sanctions imposed on the people of Iraq for a decade, the deployment of massive numbers of American troops near to Muslim sacred sites, and the enabling over the course of many years of Israel’s oppressive dispossession and occupation of Palestinian lands. From this perspective, the crimes of 9/11 were widely understood as an outgrowth of the wrongs of 9/10 and led unreflectively to the crimes and strategic mistakes of 9/12.  Such a critical understanding does not diminish the criminality of attacks directed at civilians, a strategic pushback that violates the most fundamental constraints of law and morality.

 

           It is probably misleading to think of 9/11 as primarily a global historical event. Undoubtedly its interpretation is mainly a national experience more affected by 9/10 and 9/12 than by the attacks themselves. Such an observation reminds us that despite the hype about globalization that was so prominent during the dawn of the Information Age in the 1990s, it is our shared lives within a particular sovereign state that continues to dominate our political consciousness. Surely most Palestinians see 9/11 through an optic reflecting their ordeal as understood on 9/10, while most Israelis likely saw 9/11 as a long overdue enabling of the 9/12 response that led Americans to share Israel’s preexisting national preoccupation with terrorism.  A deeper encounter with 9/11 ten years later allows us to sense more clearly that most of us are still living in a world of sovereign states despite the borderless wonders of social networking and other globalizing phenomena of this historical period. Even Europe that seemed to go further toward establishing a state-transcending civilizational identity required only the stress of an economic recession to bring back its strong conviction that what mattered most was not being a European but rather being Italian, Spanish, Greek, or French.

 

            Of course, for Americans this is not so obvious. The United States is truly a global state, perhaps the first in history, with the capabilities and commitment to act anywhere on the planet if its vital interests are at stake. From this perspective, 9/11 was experienced by many Americans as a challenge that could be neither addressed territorially nor by retaliatory attacks on the enemy state that inflicted the harm.  The leaders at the time, but with wide national backing, insisted that future security meant limiting freedom at home while waging war abroad. It was this global projection of this American security response that made it natural for 9/12 to be the day that most stays in the mind of foreigners, perhaps not literally, but through their feelings of victimization that resulted from the American respnse by way of war rather than through reliance on the enforcement of law against those who commit crimes against humanity. This latter road not taken, and not even seriously considered, might have been the most radical peacemaking experiment in all of modern history. It was far too radical for either the leadership or the citizenry of not only America, but the constituted politics of all states.

 

            With this outlook of American geopolitical exceptionalism, globalization seems real. When Barrack Obama was elected the American president in November 2008, it was a global event, with people the world over often believing that his election was more important for their future than the outcome of their own national elections. When Lula went to a meeting in Europe of the G-20 while he was still President of Brazil he said that he prayed for Obama more than for himself. The American role in the world economy and security system is truly global, but does that mean that 9/11 was interpreted as a blow struck against the whole world as George W. Bush insisted at the time? Hardly. For parts of the world it meant new and increased violence in their homeland, drones attacking targets selected in the U.S., special forces and an array of mercenaries roaming covertly in search of terrorist suspects, and new wars.

 

 

           We are, of course, free to remember certain things and to forget others. This is normally not done consciously, but it will explain the incredible diversity of how 9/11 was observed on its tenth anniversary, itself a milestone that causes especially Americans to pause and reflect. For most Americans, this became an occasion for a renewal of remorse, lament, resolve, and anger, if not rage.

 

            The most innocent memories of 9/11 are those of loss, a recollectionthat is both personal and collective, associated with any human tragedy caused deliberately that has a negative impact on innocent civilian lives. Less innocent, and more relevant ten years later, is the complexity surrounding the response that is prompted by fear, revenge, counter-crusading passions, and geopolitical ambition. In these respects, 9/11 is both text and pretext, and gave way to the 9/12 furies that unleashed a global war on terror that has caused widespread destruction, questionable improvements in security, and a general weakening of the American claim to exercise global leadership.

Syria: Geopolitical Mentoring versus Rehab for Addicted Geopolitical Leaders

             On August 18th President Barack Obama rendered judgment and gave guidance. While affirming that “[t]he future of Syria must be determined by its own people” he added these words, “Bashar al-Assad is standing in their way.” And so comes the conclusion: “For the sake of the Syrian people, the time has come for President Assad to step aside.” This American leader’s advice was orchestrated to coincide with the release of a joint statement along similar lines by the leaders of Germany, France, and Britain, the three most important countries in Europe, that instructed President Assad to “leave power in the greater interests of Syria and the unity of its people.”

 

            More than advice was being offered. Sanctions against Syria were imposed and tightened involving energy imports, business connections, and weapons. Other countries were urged to stop their support for the Syrian regime, and “get on the right side of history.” Such words seemed appropriate given the violent behavior of the regime toward its people, except that the source of this utterance was the American Secretary of State, Hilary Clinton, who herself might well have been the recipient of the same message, refusing heeding this prudent admonition in the course of conducting American foreign policy during the Obama presidency.

 

            The Republicans, always quick to seize any opportunity for a partisan snipe, attacked Obama for waiting so long before telling the Syrian leader to get out of his home town. With a perfect ear for geopolitical mentoring, the leading Republican presidential hopeful, Mitt Romney, was clear in his portrayal of the proper American role: “America must show leadership on the world stage and work to move these developing countries toward modernity.” Of course, decoding ‘modernity’ suggests the United States model of government and economy: be like us and you will be modern, and successful.

Not a message likely to get a favorable hearing in Pakistan or most anywhere in the South, but maybe such ‘modernity’ is what the people of Alabama and Arizona desire.

 

            But it was not only Republicans that had this idea that the United States offers the world the best model of humane and legitimate governance. Hilary Clinton made clear that governments sharing American values should join together in opposing the Syrian regime through the use of what she called “‘smart power,’ where it is not just brute force, it is not just unilateralism,” but rather it is behavior shaped by shared commitments to “universal freedom, human rights, democracy, everything we have stood for and pioneered over 235.” Clinton seems to be proposing what was previously called ‘a coalition of the willing’ in relation to the wars fought over Kosovo in 1999 and Iraq since 2003.  But what makes these sentiments worthy of comment is their seeming unawareness of how starkly they contradict the America record throughout those 235 years. And, of course, it is not only a matter of bad history as the ongoing interventions in Afghanistan, Iraq, and Libya are pretty much displays of brute force and, if not unilateralism, then at least West-centric interventions that sought to superimpose a West-oriented secular governing process onto the internal workings of the politics of self-determination.

 

            President Obama’s guidance on Syria is equally suspect, although less blatantly so. What does it mean to tell the established leadership in Damascus to step aside while affirming the role of the Syrian people in shaping their own future? Such inescapable incoherence must be hiding something deeper!

 

            This theatrical exhibition that I am describing as ‘geopolitical mentoring’ seems both regrettable and discrediting. To begin with, the words and ideas relied upon by Obama and Clinton seems to emanate directly from the good old days of undisguised colonialism. The language chosen suggests a kind of ideological regression that is forgetful of the very flow of history that Secretary Clinton was keen to invoke by way of discouraging such countries as Russia, China, India, and Iran from maintaining normal relations with the Damascus regime. What this self-righteous posturing discloses is the familiar imperial trait of talking endlessly about what others should do but never listening to what others tell us to do. A half century ago Adlai Stevenson made a similar observation when he quipped, “the item of technology that America most needs is a hearing aid.” Without genuine listening there is no learning. This is the price being paid by all of us for this self-entrapment of the imperial mind.

 

            But there is also the unwillingness to address global problems in a more plausible and constructive manner. To be sure Obama/Clinton wish to rely on collaborative diplomacy, a contrast with the greater unilateralism of the Bush II presidency, so as to shed the image and avoid the costs of acting alone. But is this really the best that smart power can do in the 21st century?  If the NATO intervention in Libya is one instance of such multilateralism then it hardly brings hope or engenders support. What is needed is an institutional capability detached from the priorities of the geopolitical mentors, what I have previously called for in the form of a UN Emergency Disaster Relief and Atrocity Prevention Force (this is along the lines proposed in “UN Emergency Peace Force,” ed.             Getting back to geopolitical mentoring: it sounds condescending even if sincere in the context. It is relevant that none of the emerging geopolitical actors, including Brazil, China, and India have joined the American led choir, and told Assad to move on. Even Turkey that has leaned strongly on Assad in recent weeks to stop state violence, provide reforms, and abide by human rights has refrained from joining in the call for his removal from power. Instead of geopolitical mentoring, it is time for some kind of geopolitical rehab program that might allow the United States to grasp the character and full extent of its actual role in the world, which continues to be dominating by an addictive relationship to military solutions. Why else linger in Iraq and Afghanistan, why kill babies in Libya? There are better ways of exhibiting empathy for the victims of state violence and brutality!

 

            There is also the issue of double standards that constantly taints the moral core of American foreign policy. How can the silence about Israel’s oppressive occupation of the West Bank and East Jerusalem otherwise be explained or the unlawful collective punishment of the people of Gaza that have endured a harsh blockade that has persisted for more than four years be allowed to go on unchallenged? Or why the indulgence of Saudi Arabia’s systemic suppression of women?  The architects of grand strategy in Washington know that smart power in world politics has been and still is all about manipulating double standards. Given the words quoted above this means that our current political leaders are either not smart or they are merely running moral interference for the smart policymakers who remain faithful to an ethos of raison d’etat, which entails that law and morality be damned.

 

            I do not deny that state atrocities of the sort the world has been witnessing in Syria and Libya during recent months are unacceptable and should not be tolerated. Moral globalization is incompatible with viewing the boundaries of sovereign states as absolute or treating their leaders as situated beyond legal and moral standards of accountability. Yet, it is a sorry commentary on present global conditions if the best we can do is either mount an airborne military intervention that destroys much of what is to be saved or engage in self-satisfied exercises in geopolitical mentoring.

 

            Of course, the future should not be entrusted to the political leaders representing sovereign states. It is up to the peoples of the world to propose and demand better solutions for the unfolding global tragedies that are sidestepped by the egocentric behavioral goals of national governments. Populist complacency is part of what gives this geopolitical posturing a semblance of credibility in our post-colonial era. A benign human future, whether in relation to state/society relations and human rights or the abatement of climate change, depends ultimately on a struggle for peace and justice mounted by energized and dedicated transnational movements. Only a global populism of as yet unimaginable intensity and vision, can provide us with the possibility of a hopeful future that we earthlings need and desire.
